A county in Ohio is now facing a lawsuit filed by numerous Juvenile Court employees who allege that they are owed unpaid overtime.
Does Cuyahoga County Owe Employees Unpaid Wages?
This latest unpaid overtime lawsuit, filed in a federal court in Cleveland, OH, has been filed on behalf of all employees of the Juvenile Court – both former and current.
According to the court records, the plaintiffs were full-time employees who were regularly scheduled to work five 8-hour shifts each week. Yet on an almost weekly basis, overtime work was performed. They allege that Cuyahoga County calculated these overtime hours as regular hours and did not calculate them as overtime. They further claim that Cuyahoga County did not properly track employee’s hours, violating the Fair Standards Labor Act (FSLA).
The plaintiffs are seeking the overtime pay that they are owed as well as their attorney’s fees, court fees, and any other compensation that that court sees fit to provide.
A Cuyahoga County representative has not responded to the allegations.
What Is The FLSA?
The FLSA is a set of federal labor laws. These laws define:
- The minimum wage.
- Overtime wages.
- When and how much children can work.
- How employees can stand up for themselves when their rights have been violated.

There are some employees that are considered exempt from the FLSA and so are therefore not entitled to the minimum wage or overtime pay.

- Employees who are considered “Executives” or “Administrators”
- Outside Sales Employees
